EG Retail wins appeal in battle with Fastned over food and drink outlet on A50 motorway

EG Retail has won the appeal against a licence for Fastned. This follows from a ruling by the Council of State. The case revolved around a permit for a two-storey manned shop at a charging station at service station De Brink on highway A50 near Apeldoorn.
In November 2023, the Minister of Infrastructure and Water Management gave permission to the fast-charging company to build at the service station “a two-storey building with toilet facilities, an area with seating, an area where food and beverages are offered and a served counter with a cold room/storage area behind it”. EG Retail, operator of a manned Esso petrol station at the same location, disagreed and went to court.
Earlier right
The court previously agreed with the minister. EG Retail then appealed. The Council of State now rules that the permit should not have been granted. According to the highest administrative court, there was in fact no valid application by Fastned. Part of the building plan was on land that did not belong to the fast-charging company. As a result, the plan could not be implemented as submitted. Since there was no valid application, the minister should not have considered it either. The 2023 permit was therefore quashed.
New application
The ruling means that the court’s earlier decision is reversed. Fastned did submit a new, amended application for the realisation at service station De Brink of “a smaller shop cum waiting room”.
According to the Council of State, that new licence is separate from these proceedings. Objections by EG Retail to the old licence are now seen as objections to the new decision. It is up to the minister to further handle that new application. The ruling ends the procedure on the 2023 licence.

EG Retail operates an Esso petrol station with a manned shop containing a Go Fresh bakery and Spar at service station De Brink on the A50 near Apeldoorn. During the petrol station auction held by the Rijksvastgoedbedrijf in September 2021, EG Retail offered over €9 million to operate the petrol station location for the next 15 years.
Fastned, as it already does in Belgium, is also keen to start selling sandwiches and coffee along Dutch motorways. Petrol stations and other parties, such as EG Group and Circle K, which have interests at service stations, oppose this.
